The CONI Board of Guarantee rules on the appeal presented by Juventus against the 15 penalty points for the capital gains case.
Juventus will take the field tomorrow in Lisbon against Sporting for the second leg of the quarter-finals of the Europa League but an equally important match for the black and white season is being played today in front of the CONI Guarantee Board .
Indeed, after so many weeks of waiting, Allegri and his boys will know which goals to fight for in the last eight days of the championship. If the appeal were accepted, Juventus would suddenly find themselves third in the standings with a margin of six points over Milan who would slip to fifth place.
If, on the other hand, CONI's Board of Guarantee confirmed the sentence of the Federal Court for the Bianconeri, continuing to hope for qualification for the next Champions League would become almost utopian, given that Juventus currently occupies seventh place - 9 behind the Rossoneri.
The hearing before the Guarantee College will open around 2.30 pm while the sentence should arrive by today evening. But it is not excluded that it could slip.
The day of truth for Juventus, however, has finally arrived. Waiting for the second trend relating to the so-called 'salary maneuver' which could lead to a new referral and another possible penalty in the standings.
WHAT CAN HAPPEN TO CONI
But what are the possible scenarios? Three hypotheses on the table:
Juventus' appeal is accepted, the Panel recognizes "a violation of the law, or for omitted or insufficient reasons regarding a decisive point of the dispute that has been the subject of dispute between the parties" (art. 12 bis paragraph 2 of the Coni Statute ). In that case the 15-point penalty would be immediately cancelled, as would the inhibitions inflicted on the former Juventus managers.
Referral to the Federal Court of Appeal, the College of Guarantee asks to reformulate the sentence. In this case the 15 points would be returned pending the new judgement.
Juventus' appeal was rejected, the Board found no violations and confirmed the sentence of the Federal Court of Appeal. In this case the sporting question would end here while Juventus could appeal to the TAR only to obtain any compensation but would not in any case get the 15 penalty points back.
